Doctor I hate got written up 11 times because of me :D

So, I kept getting stuck with this one doctor whenever I was hospitalized who worked with my actual doctor. I hated him. He hated me. It was super. I would always demand a new doctor and he would refuse (which is apparently against the law and they were just doing it hoping I would leave against medical advice). This asshat was very against giving ANY pain medication to IBD patients. He believed that since we aren't going to die, we should just learn to deal with it. Awesome ideals, right?

Well, this little asshat tried to grab the phone out of my fiancee's hand when he started to record the conversation and then refused to treat me because of it. That's illegal in Ohio seeing as patients have the right to record any conversations with medical professionals with or without their permission. Apparently, if I would have filed assault charges he would have gotten fired. He was also awesome enough to refuse to tell me my plan of care (which he legally has to do seeing as I am a medicare patient).

It turns out that he tries to get my case whenever I am there just so he can attempt to get me kicked out of the hospital for good. Despite all of the shit that they have made up about me, it hasn't worked and he just gets written up for it. I was told by my doctor that I do have the right to a new doctor and that he DOES have to contact him if I ask for that to happen... he was refusing to contact my actual doctor when I was hospitalized. After I have my little girl I am planning on going back to the hospital with a concealable recording device so I can catch everything he is saying and get him fired... and possibly ensure I get better healthcare out of fear of a lawsuit :D
 
Hi Amanda I know exactly what you are talking about. I have the same problem when I go to the ER and get admitted. I get the same DR. each time who does not want to give me anything for pain or really do anything to help me. She is convinced that I am a drug seeker and always request that I have psych consult for depression. She just refuses to believe that I can have so many health problems at the age of 34.

I did not know that illness had a age requirement. I have requested a new DR. the last two times and they always send me someone that works with and they consult her on what to do with me. They hardly ever consult any of my regular docs. She also told me that everything wrong with me is chronic so I just need to learn to live with the pain. I wish she could just live one day of my life, I bet she would change her tune real quick.

I have reported her several times but as of yet nothing has been done to her about how she treats me. I will definitely try recording her if I run into her again. I hope that you are able to get something done about him.

Also what part of Ohio are you in? I was born and raised in Dayton.
 
Have you considered seeing an attorney about just filing a lawsuit instead? There's a lot of attorneys who will do malpractice lawsuits on a contingency basis -- meaning they only get paid out of any proceeds when and if they win the case. You sue the hospital,not the doctor directly.
 
I'm from Cincinnati and this lovely treatment happens at a lovely learning hospital there. My doctor is amazing, this other doctor... not so much. Every nurse hates this man and calls him a sadist. I've taken to calling him Dr. Mengele whenever he walks in (which made my Jewish doctor giggle a bit I think).

I've tried calling attorneys, but they are all afraid to take cases against this hospital because they spend a FORTUNE on lawyers and their patient relations department is basically there to destroy records that incriminate them. Patient relations actually came in to inform me that I shouldn't even bother suing because they had already destroyed my records. My fiancee used to work there while he was a psych and confirmed that they do do that... which is one of the reasons why he refused to sign a contract with them.

I live in Illinois, which is a "2 party" state, meaning that is illegal to secretly record conversations without the consent of all parties to the conversations.

However, Ohio is a one party state, meaning that is legal in Ohio to secretly record any and all conversations, as long as you are one of the parties involved in the conversation.

So don't tell or let them know that you are recording the conversations. Just do it. If you can obtain some incriminating evidence, you should have no problem finding an attorney more than willing to take on your case, especially if you can get someone there to admit they intentionally and routinely destroy patient records. Or that this doctor refuses to comply with laws requiring him to provide you with another doctor, advise you on your care plan, and contact your own physician. Those are pretty serious violations, and if they can be proven, should easily make your case well worth taking on.

If you have no proof at this time though, you may want to revise your previous post--and remove the name of the hospital. If this hospital retains aggressive attorneys, it is highly probable that they routinely perform Internet searches to ensure this type of knowledge does not become public, and may even threaten you with a lawsuit. Of course, if you're on Medicare, you probably don't have anything they could sue you for anyway, and if they tried, well, lawsuits are a matter of public record, which would undoubtably would harm them far more than it would you.

Thank you, I went ahead and edited it... great ideas. Patient relations always says something stupid so I'm sure it won't be that difficult to catch them...
 
I have never been told to just deal with my chronic pain, I probably would of flipped. I hope you get all of these issues resolved and get the care you need and deserve. When are you due?

amandaerin: I'm also from Cincinnati. If it's the hospital I'm thinking of, I had problems with them also. I was admitted twice because of GI issues.

The 1st time, they didn't want do do a scope or anything on me. They wouldn't let me see a GI doctor. They basically said it was all in my head and dismissed the abnormal test results.

The 2nd time, I saw GI doctors. They were not very friendly. One doctor told everyone in my room that I complained to patient relations about the clinic. They wouldn't give me a straight answer if I was going to have a colonoscopy. They also basically dismissed the abnormal test results. The only pain medicine they gave me was Toradol.

My sister had problems with that hospital also. They wouldn't listen to her and dismissed her symptoms.
